Do not panic. First check the specific reason for denial. If you were refused under Section 221(g) for missing documents, simply submit the requested materials. If you were denied due to background issues or membership in a prohibited organization, you may be eligible for an I-601 waiver if you have a qualifying US citizen or green card holding immediate relative. Alternatively, if you can enter the US on another non-immigrant visa (such as H/L/O), you may adjust status to green card through I-485 inside the US, which generally has more lenient standards than consular processing overseas. The I-601 waiver is generally for applicants who are inadmissible to the US (for example, prior CCP membership, past immigration violations). You must prove that denying your entry would cause Extreme Hardship to your US citizen or green card holding qualifying relative (spouse or parent).
Processing times vary by filing location. Filing inside the US typically takes a few weeks to a few months, and our firm has obtained approvals in as little as one month. Filing overseas can take over a year, so we recommend planning ahead.

1. Complete & Truthful Documentation: Do not hide critical information such as your work history or past organizational membership. US authorities are now conducting very strict background checks.
2. Prove Your Intent to Reside in the US: Show you have concrete plans to live long-term in the US, not just obtain a green card.
3. Prepare for Sensitive Questions: If you have past political party or government work experience, prepare a detailed detailed statement in advance explaining your situation, including if you have ended your membership, and the circumstances of your involvement.
4. Interview Performance: Answer questions clearly and confidently; do not be vague or evasive.

You must use the most recent version of Form I-693 for adjustment of status filings inside the US, and use the specific required form at a US government-approved medical clinic overseas. You must complete all required vaccinations (such as hepatitis B, influenza, etc.). If you cannot receive certain vaccinations due to medical reasons or pregnancy, you can apply for a vaccination exemption. Medical exam reports are generally required at the time of filing or interview, and have a limited validity period, so you should plan your timeline carefully.

The K-1 fiancé(e) visa process for a US citizen petitioning an overseas fiancé(e):
1. File Form I-129F with USCIS.
2. After approval, the case is transferred to NVC, then forwarded to the US consulate in your home country.
3. The beneficiary attends the consular interview and receives the K-1 visa.
4. After entering the US, you must marry within 90 days, then file Form I-485 to adjust status to a green card.
Note: K-1 visa holders must marry the original petitioner after entry; you cannot marry a different person and keep your immigration eligibility.

If you are eligible (already in the US or can enter on a valid non-immigrant visa), filing for I-485 adjustment of status inside the US is generally more advantageous under current conditions. It falls under the jurisdiction of the Department of Homeland Security, is less affected by political policy fluctuations between the US and China, and allows for attorney representation at your interview. Consular immigrant visa processing in China falls under the Department of State, is more affected by US-China relations, and has very limited appeal options if denied. If you have a complex background, we generally recommend prioritizing adjustment of status inside the US.
