第一种:全球通用的豁免,针对违反法律或移民法(如犯罪、欺诈/提供错误信息、挂靠、身份过期、传染病)。这需要证明有美国公民或绿卡亲属(配偶/父母),且若被拒会对该亲属造成“极端困难”(Extreme Hardship)。
第二种:中国特有的,关于组织成员身份。这种豁免可以基于配偶、父母、兄弟姐妹或子女(包括在美国出生的子女)。而且,不需要证明 Extreme Hardship,只要说明自己不是对美国安全的威胁即可。
Type 1: A general waiver available worldwide for violations of criminal or immigration law (such as crimes, fraud/misrepresentation, misrepresentation of status, expired status, and communicable diseases). This requires proving you have a qualifying US citizen or green card relative (spouse/parents) and that denial would cause "Extreme Hardship" to that relative.
Type 2: China-specific waiver for membership in certain organizations. This waiver can be based on a spouse, parents, siblings, or children (including US-born children). Additionally, you do not need to prove Extreme Hardship—you only need to show you are not a threat to US security.
如果人在美国境内提交,审批比较快,一般在一个月或者几个月内批准(我们律所有19天获批的案例)。如果是在美国境外办理(通常在移民签证被拒后),目前一般需要一年多到两年时间,但不会像网传的要36个月那么久。豁免批准后,在美国可以接着获批绿卡,在境外可以取得移民签证。
If filed within the United States, adjudication is faster, generally approved within one to several months (our law firm has a case approved in just 19 days). If processed outside the US (typically after an immigrant visa denial), it currently takes one to two years, but not the 36 months widely reported online. After the waiver is approved, you can proceed to get your green card if you are in the US, or obtain your immigrant visa if you are abroad.
豁免不是有了亲属关系就“自动批准”的。不能摆烂说“我有亲属,你看着办”。你必须提供两方面证据:
1. 必要条件:符合法律要求的亲属关系和(如需要)极端困难。
2. 有利因素 (Favorable Factors):如在美国居住时间长、有稳定工作、无犯罪记录、家庭贡献等。
你需要从实质上解释为什么以前的违规是轻微的、不再是威胁,要说服移民局行使裁量权批准你。
A waiver is not "automatically approved" just because you have a qualifying relative. You cannot simply state "I have a qualifying relative, it's up to you". You must provide evidence in two areas:
1. Prerequisites: A legally qualifying relationship and (if required) extreme hardship.
2. Favorable Factors: Such as long-term residence in the US, stable employment, clean criminal record, family contributions, etc.
You must substantively explain why your previous violation was minor and you are no longer a threat, and convince USCIS to exercise discretion to approve your application.

USCIS publishes an overall approval rate of over 80%. In the past three years, we have obtained over 70 waiver approvals, with very few rejections. The main reasons for rejection include:
1. Applicant doesn't actually qualify with the required relative (applying on a whim);
2. Leaving the US after submission is considered abandonment;
3. Only claiming "extreme hardship" without providing any documentary evidence (such as medical records, financial evidence).
With a relatively straightforward case and professional preparation, the approval rate is very high.

Yes, you can. Many of our cases come to us after receiving a Notice of Intent to Deny (NOID) following the green card interview, or after an outright green card denial. We then file an I-601 waiver application for them (sometimes combined with a Motion to Reopen). As long as you meet the qualifications, even if your status has expired, you can still get your green card through a waiver. We recently had a case where the applicant re-applied after a green card denial and added a waiver, and everything was approved in just four months.
身份失效 (Out of Status): 指违反了签证规定(如F1不经许可工作、未满学分),但I-94可能还没过期。这会导致你不能在境内转身份。
非法居留 (Unlawful Presence): 指I-94过期后仍滞留,或被移民局正式裁定身份非法。非法居留超过180天离境会面临3年禁止入境,超过1年则面临10年禁止入境。这时必须办豁免才能拿绿卡。
Out of Status: This means you violated your visa conditions (such as working without permission on F1, dropping below full-time credits), but your I-94 may not yet have expired. This makes you ineligible to adjust status within the US.
Unlawful Presence: This means you have remained in the US after your I-94 expired, or have been officially found by USCIS to be unlawfully present. More than 180 days of unlawful presence followed by departure triggers a 3-year bar to re-entry, and more than 1 year triggers a 10-year bar. A waiver is required to overcome these bars to obtain a green card.
