Chinese or White Immigration Lawyer? When Choosing a U.S. Green Card Attorney, Judge Competence, Not Skin Color

By Attorney Cai, New Weiming Law Group

TL;DR (English): When handling a U.S. green card, visa, or status matter, choose an attorney based on competence, diligence, specialization, experience, and reputation, not skin color or ethnicity. U.S. law is a professional discipline, not a racial trait; both white and Chinese-American attorneys include highly skilled practitioners as well as inexperienced ones. EB-1A, NIW, O-1, I-485, I-601 waivers, and RFE responses require rigorous legal analysis, evidence strategy, and English legal writing, not just form-filling. A two-page explanation submitted for a complex I-485 issue shows that an attorney's race does not automatically confer expertise. Don't blindly trust anyone based on race; for professional matters, choose a qualified professional.

New Weiming Law Group is based in the Washington D.C. metropolitan area and has long represented Chinese nationals, international students, postdocs, and STEM professionals in the DMV region, Maryland, Virginia, and nationwide in EB-1A, NIW, O-1, H-1B, L-1, PERM, and I-140/I-485 matters. We are often asked: for a U.S. green card, visa, or status matter, should I hire a Chinese-American lawyer or a white lawyer? The question seems simple, but it often reflects a deep-seated bias. Many people judge programmers, engineers, and scientists by ability, yet when choosing a lawyer they assume a white attorney must be more professional, write better English, and be more readily accepted by the U.S. government. Is that really true?

Should You Hire a Chinese-American or a White Lawyer for Your Green Card?

The answer: judge ability, not skin color. U.S. law is a professional discipline, not a racial trait. White people are not born knowing U.S. law, and Chinese people are not born unable to master it. There are excellent white attorneys and underqualified ones; there are excellent Chinese-American attorneys and inexperienced ones. Two lawyers from U.S. law schools with the same license can differ enormously in skill, experience, diligence, and work quality. USCIS evaluates the facts, evidence, and legal arguments in a filing, not what the attorney looks like.

What Kind of Blind Foreign Worship Did a Late-Qing Novel Satirize?

Bizarre Happenings Eyewitnessed over Two Decades, a late-Qing satirical novel by Wu Jianren, portrays officials who lacked scientific knowledge yet blindly worshipped foreigners. The book notes that some foreigners understand science and some do not, just as not every Chinese scholar could write a good examination essay. One character remarks that officials, "upon seeing anyone without a queue (a Westerner), even a foreign beggar, would regard him as a heavenly immortal." The root cause, the novel suggests, was a lack of learning and independent judgment: these officials judged ability by appearance and status alone.

The "kerosene from coal" fiasco: One official, praised by his superiors as "versed in both Chinese and Western learning," heard that a foreign machine could extract large amounts of lamp kerosene from coal. He raised money, recruited investors, and bought so much coal in Chongqing that prices rose and a foreign consul took notice. The astonished consul explained that lamp kerosene comes from petroleum, not ordinary coal. The whole venture turned out to stem from a dialect misunderstanding between people from Ningbo and Guangdong, who had garbled "oil press" into "kerosene refining machine." The loss was caused not by a foreign swindler but by the official's own ignorance, credulity, and blind faith in "advanced foreign technology."

Wu Jianren was not mocking foreigners; he was mocking people who pretended to know, worshipped foreigners blindly, and lacked judgment. More than a century later, the Qing queue is long gone, but for some people the queue in their thinking has yet to be cut.

Why Judge Programmers by Skill but Lawyers by Skin Color?

Today, Chinese scientists, engineers, programmers, physicians, professors, and entrepreneurs work across every sector in the U.S. Many Chinese applicants hold U.S. master's or doctoral degrees, work in tech R&D or research labs, and know firsthand how many highly capable Chinese professionals there are. You would never insist that "code written by a white programmer must be better"; for engineers and scientists, you look at education, technical skill, experience, results, and problem-solving ability. Yet when it comes to their own green card, visa, or status, some people suddenly switch standards: "Is a white lawyer better?" "Does USCIS prefer filings from white lawyers?" The Qing official assumed anyone without a queue understood Western science; some people today assume anyone with a white face must master U.S. immigration law. The two mindsets are essentially the same.

What Does a Recent I-485 Case Show?

Recently, an applicant facing a difficult issue at the final green card stage, I-485 Adjustment of Status, came to New Weiming Law Group for help. He had previously hired a local white attorney, assuming a local lawyer would naturally know U.S. law well. When I reviewed the explanation that attorney had prepared, I was surprised: the entire legal document, including the letterhead and address, was only two pages, and the text actually analyzing facts, explaining the law, and making arguments was even shorter. The applicant's problem was not a typo or a missing copy; it required careful analysis of immigration regulations, personal background, filing history, and evidence. Based on my review, the prior argument was clearly insufficient: it did not explain the key issues or make full use of the facts and evidence favorable to the applicant.

What Should an Attorney Do for a Complex I-485 Issue?

Understand the applicant's facts and map prior visa, status, and immigration filing history
Identify the legal issues USCIS is focused on and research the applicable regulations and policy
Build targeted legal arguments from the specific facts, supported by documents and objective evidence
Where exceptions, waivers, or possible misunderstandings apply, explain point by point why the application should be approved

Of course, longer is not automatically better; what matters is whether a document addresses the key points with adequate factual and legal support. Simple issues can be explained in a page or two, but this applicant's situation was not simple. The prior attorney did not acquire the ability to handle a complex immigration problem because of his skin color. We see similar consultations fairly often: applicants who paid fees and waited a long time, only to find their filings underprepared, key issues unresolved, and later applications made harder. To be clear, I am not saying all white attorneys work this way, nor that all Chinese-American attorneys are better. The point is precisely this: attorney quality varies, and race is not a measure of professional competence.

Why Is U.S. Immigration Law More Than Filling Out Forms?

Many people think an immigration lawyer's job is filling out the I-140, I-485, I-129, or I-130 and attaching supporting documents. Experienced immigration attorneys know forms are only part of the work. A good immigration attorney is not a form-filler but a problem-solver who applies legal knowledge and practical experience: knowing the exceptions as well as the rules, spotting favorable facts as well as unfavorable ones, and proposing solutions rather than merely identifying problems. None of these skills depends on whether the attorney is Chinese-American or white.

Where Does New Weiming Law Group's Professional Strength Come From?

I am Attorney Cai of New Weiming Law Group. I earned my B.S. in chemistry from Peking University, a Ph.D. in chemistry from the University of Maryland, and a J.D. from Georgetown University Law Center, with an LSAT score in the top 0.1% of test takers worldwide. Our firm's strength comes from education, professional training, experience, a track record of approvals, and diligent service, not from the fact that we are Chinese-American. Not every Chinese-American attorney has this background or these skills.

Five Professional Strengths

Dual STEM Ph.D. and J.D. background: research experience with publications, patents, and academic evaluation, combined with rigorous U.S. legal training, which is especially valuable for EB-1A, NIW, and O-1 cases.
Personal NIW experience: I obtained my own green card through NIW before finishing my Ph.D.; several colleagues also have STEM Ph.D. or postdoc backgrounds and obtained green cards through EB-1A or NIW.
17+ years and thousands of approvals: per firm records, we have helped thousands of applicants obtain immigration, green card, and visa approvals across EB-1A, NIW, H-1B, O-1, J-1, L-1, I-485, family-based, PERM, I-601 waivers, membership issues, and reinstatement. Past volume does not guarantee any new approval, but it helps us spot issues, focus on what matters, and reduce errors.
Focus on legal argument and evidence: we draft petition letters, analyze the approval standards, organize objective evidence, and plan recommendation letters rather than simply forwarding a CV and papers; for RFEs or complex histories, we develop targeted strategies. English is a tool, not the whole of professional skill.
Bilingual communication and long-term planning: we weigh F-1, J-1, H-1B, O-1, L-1, EB-1A, NIW, PERM, and I-485 pathways together, including issues like Dual Intent, to solve today's problem and plan for the years ahead.

What Five Factors Should You Use to Choose an Immigration Attorney?

When choosing an attorney for a U.S. green card, visa, or status matter, look at five factors: competence, diligence, specialization, experience, and reputation. None of them has anything to do with skin color. A white attorney who meets these standards is worth hiring; so is a Chinese-American attorney who meets them. Conversely, no attorney of any background deserves blind trust based on appearance alone if they lack skill, experience, or diligence. No responsible attorney should guarantee approval, because the final decision rests with the U.S. government.

Competence
What legal training do they have? How strong is their analysis and English legal writing? Can they grasp your issue and propose a persuasive solution?
Diligence
Do they take time to learn your facts and review materials carefully? Do they solve problems or brush them off?
Specialization
Real estate, personal injury, or criminal lawyers may not know immigration; even immigration lawyers specialize in family, asylum, removal, or EB-1A/NIW/work visas
Experience
How many similar cases have they handled? Do they know USCIS adjudication patterns, common RFEs, and current policy?
Reputation
What do client reviews, professional reputation, track record, and communication quality show? Don't rely on ads or verbal promises

Why Shouldn't You Let Bias Cost You Your Future?

Many Chinese professionals today graduated from top U.S. universities and have worked for years in tech, finance, academia, and medicine; they know full well what Chinese professionals contribute. If Chinese people can be excellent programmers, engineers, scientists, and physicians, why not excellent U.S. lawyers? If you worry about bias against Chinese people in American society, why adopt that same bias when choosing professional services and use it to judge your own community? Some people spend years and hundreds of thousands of dollars earning advanced degrees and joining tech companies, then entrust their green card to an attorney unfamiliar with the work or not diligent enough, simply because they assume a foreigner is more reliable. When problems arise, they must hire another lawyer to fix them, at greater cost in time, effort, and money. I am not urging anyone to hire a Chinese-American lawyer simply because they are Chinese; that is just swinging to the other extreme. Don't trust someone blindly because they are white, and don't underestimate someone because they are Chinese.

For a U.S. green card, choose your lawyer by ability, not skin color. Don't blindly trust foreigners, and don't blindly trust fellow Chinese. Don't let bias cloud your judgment or derail your future. For professional matters, choose a professional; for important matters, choose someone capable, experienced, and responsible.
