New Weiming Law Group, working with an independent senior U.S. economist and accepting no sponsorship from any regional center or developer, reviewed the Southern Student Housing EB-5 project in Atlanta. Located next to Georgia Tech in a Targeted Employment Area (TEA), the project seeks $32 million from about 40 investors at $800,000 each. It projects roughly 700 jobs, a cushion of about 300 above the 400-job minimum. As of November 2024, construction was over 50% complete, with completion expected in July 2025 and EB-5 repayment planned for 2028. Our ratings: Funding Sources, Market Prospect, Operational Forecast, Economic Impact, and Investor Security each 5/5; Risk Level 4/5. This is an independent informational analysis, not a project recommendation or legal advice. EB-5 investments are inherently at risk.

Green card backlogs, limited job opportunities for international students, the H-1B lottery, and Chinese families' plans for their children's education and careers are driving more Chinese applicants to consider EB-5, especially since Congress enacted the EB-5 Reform and Integrity Act (RIA). Many F-1 graduates fail the H-1B lottery repeatedly after OPT, and researchers face lengthening priority date backlogs for EB-1A, NIW, and employer-sponsored EB-2/EB-3 (via PERM and Form I-140). As a result, EB-5's currently backlog-free set-aside categories and the option to concurrently file Form I-526E and Form I-485 inside the U.S. have drawn growing interest. One of the biggest questions investors ask is how to identify a reliable project among countless marketing materials. Much like picking stocks, the final decision belongs to the investor, but better information supports a better decision. Having served the Chinese community in the Washington D.C. metropolitan area for over 17 years, New Weiming Law Group regularly receives these questions from investor families across the DMV area, including Maryland and Virginia. That is why we launched this independent EB-5 project review series.

Q1: What Is the Southern Student Housing EB-5 Project in Atlanta?

The Southern Student Housing Project addresses the growing demand for student accommodations in Atlanta, Georgia. Located at 564 Centennial Olympic Parkway NW, the 8-story development includes 100 residential units with 307 student beds and more than 6,000 square feet of leasable retail and restaurant space. It also offers 60 parking spaces adjacent to Georgia Tech's 45,000-seat Bobby Dodd Stadium, which will generate added revenue through event parking. The project is managed by Dezhu Investment LLC, a Georgia-based developer with a history of successful real estate ventures. It is affiliated with the American Southern Regional Center (ASRC), a USCIS-designated regional center approved on September 22, 2016, which focuses on EB-5 investments in real estate, hospitality, and infrastructure across Georgia. ASRC's involvement supports compliance with EB-5 requirements, particularly job creation and economic impact. As of November 2024, construction was over halfway complete, with expected completion in July 2025. Effective use of EB-5 funds has minimized draws on the $39 million construction loan, leaving substantial reserves.

Q2: What Are the Key Highlights of This Project?

Prime location with strong demand: the project sits near several major Atlanta institutions, including Georgia Tech, where record enrollment has pushed student housing demand well beyond supply. Secured construction financing: only a small portion of the $39 million construction loan has been drawn thanks to effective use of EB-5 funds, leaving substantial reserves. Mixed-use design: 100 residential units combined with 6,000+ square feet of retail and restaurant space serve both students and the wider community and diversify income. Major construction progress: over 50% complete as of November 2024, ahead of schedule, and on track for a July 2025 completion before the new academic year.

Q3: How Is the Project Funded?

The project uses a balanced capital structure: a $10 million senior loan from Keystone National Group; $13.85 million in developer equity from Dezhu Investment LLC, demonstrating strong commitment and confidence; $32 million to be raised from about 40 EB-5 investors at $800,000 each under the TEA threshold; and a secured $39 million construction loan held as contingency, of which only a small portion has been drawn. Attorney's note: senior and construction lenders are typically repaid ahead of EB-5 capital. Investors should verify each funding source's position in the capital stack, the collateral arrangements, and the relationship between the construction loan and the senior loan in the Private Placement Memorandum (PPM) and loan documents.

Q4: What Is the Market Outlook for Student Housing in Atlanta?

According to the economist's report, the project has a strong market foundation. Georgia Tech's enrollment grew by more than 16,000 students from 2019 to 2024, setting new records every year, while on-campus housing accommodates only about 8,700 residents, pushing many students off campus. Atlanta's existing student housing operates at high occupancy and remains undersupplied, and the project is positioned as a top-tier option. Retail and restaurant space adds convenience for residents, attracts foot traffic from students and locals, and creates additional income. Atlanta continues to show robust growth through a diverse job market, thriving infrastructure, and population gains, and the Centennial Olympic Parkway area is being redeveloped as part of a broader urban revitalization. With higher-than-anticipated demand, the project's revenues are expected to rise.

Q5: How Many Jobs Will the Project Create, and Does It Meet EB-5 Requirements?

Each EB-5 investor must create 10 full-time jobs, so 40 investors require 400 jobs. The project projects about 700 jobs, a buffer of roughly 300. Even if actual job creation falls slightly short of projections, this cushion helps all investors meet job creation requirements at the I-526E and later I-829 stages. Regional center projects may count direct, indirect, and induced jobs using economic models. Job sources include construction-phase design, engineering, and construction management roles; long-term retail and restaurant operations; and ongoing property management. Substantial unused construction loan reserves further support completion and the job creation goals. Regionally, new residents will boost spending at local businesses and support the redevelopment of Atlanta's Midtown area. The project anticipates full repayment of EB-5 capital by 2028. Its TEA location qualifies it for the reduced $800,000 investment threshold instead of $1,050,000.

Q6: What Are the Project's Operational and Revenue Forecasts?

The operational outlook is strong, driven by high student housing demand, strategic financial planning, and experienced management. Completion in July 2025 aligns with the 2025-2026 academic year for optimal lease-up. Expected occupancy is 90% in Year 1 (2025-2026), stabilizing at 95%-97% by Year 2. Residential leases are projected to generate $5.72 million to $6.35 million annually for the first five years after completion, and retail space is expected to add $800,000 to $1.2 million annually. EB-5 capital repayment is anticipated by 2028, supported by stable cash flow. Dezhu Investment LLC manages the property, with reserve funds allocated for maintenance and contingencies.

Q7: What Are the Main Risks and How Are They Mitigated?

While well structured, the project is not without risk. Overall, we view it as moderate risk, primarily from typical construction and regulatory uncertainties. These are mitigated by advanced construction progress, strong student housing demand, and financial safeguards, and the likelihood of significant disruption is low. Construction delays from supply chain issues, labor shortages, weather, or site problems are offset by over 50% completion and substantial unused construction loan reserves. Enrollment risk is offset by five consecutive years of record growth at Georgia Tech and an undersupplied market. Revenue risk is offset by diversified residential and retail income and experienced management. Regulatory risk, including policy changes, processing delays, or RFEs, is offset by an oversized job creation cushion and ASRC compliance oversight. Economic risk is offset by the resilience of student housing demand and advanced construction progress.

Q9: What Is New Weiming Law Group's Overall Conclusion?

The Southern Student Housing EB-5 Project stands out in the current EB-5 market. With advanced construction progress, strong financial reserves, and rising demand for student housing, it presents relatively low risk while offering meaningful potential benefits. For EB-5 investors, the combination of a robust job creation cushion, market strength, and investor protections makes it an attractive option.

Q10: What Due Diligence and Immigration Planning Should Investors Complete Before Investing?

(Source and Path of Funds),这是I-526E审理和RFE的重点。

Regardless of a project's ratings, EB-5 capital must remain "at risk," and any guarantee of principal or fixed returns is not permitted. From an immigration attorney's perspective, investors should: verify the filing or approval status of the project's Form I-956F and review the PPM, subscription agreement, escrow release terms, collateral documents, and refund mechanism; confirm the TEA type (high-unemployment or rural) through official designation documents, since it affects set-aside allocation and processing priority; prepare lawful source-of-funds and path-of-funds documentation, a key focus of I-526E adjudication and RFEs; consider concurrent I-526E and I-485 filing while set-aside categories are current to obtain an EAD and Advance Parole and lock in children's ages under CSPA, noting that H-1B, L-1, and O-1 carry dual intent while F-1 does not, so F-1 holders should be careful about travel, and J-1 holders should confirm whether the two-year home residency requirement applies and seek a J-1 waiver if needed; and, for eligible postdocs and researchers, evaluate NIW or EB-1A alongside EB-5.
