The Top 5 EB-5 Investor Questions: Total Costs, Escrow Release, Green Card Timeline, Risks, and Project Selection

As H-1B and F-1 policies tighten and EB-1A/NIW backlogs grow, EB-5 (minimum $800,000 in a Targeted Employment Area) has become a key alternative for international students and their families: set-aside visa categories are currently largely backlog-free, and eligible applicants inside the U.S. may concurrently file Form I-526E and Form I-485. Investors should budget for roughly $100,000+ in additional costs, scrutinize escrow release terms, expect a timeline of three years or more, and understand that the risk of not obtaining a green card is relatively low, while the risk of losing part of the investment is comparatively higher. New Weiming Law Group offers free evaluations to families in the Washington D.C. (DMV) area.

Having served the Chinese community in the Washington D.C. metropolitan area for over 17 years, New Weiming Law Group is receiving a growing number of EB-5 inquiries from students and parents across the DMV area, including Maryland and Virginia. The reasons are practical: tighter work and student visa policies have made employer-sponsored EB-2/EB-3 green cards (via PERM and Form I-140) harder to obtain; priority date backlogs for EB-1A and NIW have lengthened; and many F-1 graduates struggle to find employment without stable status once OPT ends or the H-1B lottery fails. Below are the five questions EB-5 investors ask us most often.

Q1: Beyond the $800,000 Investment, What Other Costs Are Involved?

Under the EB-5 Reform and Integrity Act of 2022 (RIA), the minimum investment is $800,000 for projects in a Targeted Employment Area (TEA, i.e., rural or high-unemployment areas) or infrastructure projects, and $1,050,000 elsewhere. Beyond the principal, investors should typically budget around $100,000 or more for: regional center administrative fees (usually tens of thousands of dollars, varying widely by project); USCIS government fees of over $10,000 (the Form I-526E filing fee is $11,160, plus fees for Form I-485 and related work/travel permits if filing concurrently, and $9,525 for the Form I-829 two years later, subject to the current USCIS fee schedule); attorney fees typically in the $20,000 to $30,000 range covering source-of-funds documentation, I-526E/I-485 preparation, and RFE responses; and miscellaneous costs such as wire transfers, translations, and accounting or valuation reports.

Q2: When Is the Investment Released from Escrow to the Project?

It depends on the specific project and the terms of the subscription and escrow agreements. There are three common models: (1) release upon I-526E approval, which is generally safer, though investors should still compare the business model, fee structure, and the track records of the developer and regional center; (2) release upon I-526E filing, where investors should closely examine the refund mechanism and the financial capacity of the refunding party if the petition is denied; and (3) a hybrid model, where a portion is released upon filing based on milestones and the remainder upon approval. Importantly, EB-5 capital must remain "at risk." Any arrangement promising guaranteed principal, guaranteed returns, or a fixed buyback may lead to denial.

Q3: How Long Does It Take to Get a Green Card with Concurrent I-526E and I-485 Filing?

It varies by case. Some applicants who filed two years ago have already received green cards. For those filing now, the timeline depends on whether the project is rural or urban/high-unemployment, USCIS processing times, and whether an RFE is issued; we estimate three years or more. The RIA directs USCIS to prioritize rural project petitions, and rural set-aside visas currently remain relatively available. Filing Form I-485 concurrently while set-aside categories are current offers key benefits: lawful presence in the U.S. during adjudication, eligibility for a work permit (EAD) and travel document (Advance Parole) independent of OPT or the H-1B lottery, and help locking in a child's age under the Child Status Protection Act (CSPA) so the child does not age out at 21. Note that H-1B, L-1, and O-1 holders benefit from dual intent and can usually maintain status after filing, whereas F-1 does not carry dual intent, so F-1 students should be cautious about international travel and consult an attorney first.

Q4: How Great Are the Risks of Losing the Investment or Failing to Obtain a Green Card?

EB-5 is, by nature, an at-risk investment. It is generally believed that since the RIA took effect, USCIS has strengthened oversight of regional centers (including audits, the EB-5 Integrity Fund, and stricter disclosure requirements), making regional centers and projects safer from a compliance standpoint than before, especially those with long, reputable track records. However, investors under the new rules have not yet reached the Form I-829 (removal of conditions) stage in large numbers, so there is not yet enough data to measure overall success rates. Our view is that the risk of not obtaining a green card is relatively low, while the risk of losing part of the investment due to project losses is comparatively higher. In addition, the RIA's grandfathering clause protects petitions filed before September 30, 2026, even if the regional center program's authorization later lapses, and the minimum investment amounts are scheduled to adjust for inflation starting in 2027, so interested families should evaluate their options early.

Q5: How Should I Choose an EB-5 Project?

Choosing an EB-5 project is similar to picking stocks: there are many options and no one-size-fits-all answer. We recommend comparing, at a minimum: the project type (rural, high-unemployment, or infrastructure, which carry different set-aside allocations and processing priorities); the track records of the developer and regional center (prior I-526/I-526E and I-829 approvals, repayment history, and litigation); the capital stack and exit strategy (whether EB-5 funds sit in senior debt, mezzanine, or equity, whether other financing is secured, and whether the repayment source is clear); the job creation cushion (each investor must create 10 full-time jobs, so projections should include a sufficient margin); and fees and escrow terms. If you have specific questions about EB-5 projects on the market, New Weiming Law Group can help you review project documents from a legal compliance perspective.
