Commonly, parents gift lawful funds to a child studying in the U.S., who files as the principal investor; alternatively, a parent files as principal, with the spouse and unmarried children under 21 as derivatives. Either way, lawful Source of Funds documentation is a key focus of USCIS review and a frequent trigger for Requests for Evidence (RFEs).

After concurrently filing I-485, applicants can generally remain in the U.S. lawfully while it is pending and may work once the EAD is issued, free from OPT limits or the H-1B lottery. Important cautions: obtain Advance Parole before traveling abroad while the I-485 is pending, or the application may be deemed abandoned (H-1B and L-1 holders returning on valid visas are an exception); F-1 status does not carry Dual Intent, so renewing an F-1 visa or entering in F-1 status after filing may be affected, whereas H-1B, L-1, and O-1 do allow dual intent; J-1 holders subject to the 212(e) two-year home residency requirement must obtain a J-1 waiver before adjusting status. Also, mainland China-born applicants face long waits in the unreserved category, while reserved categories such as rural typically offer an advantage—always check the current Visa Bulletin.

After decades of rapid growth, countless Chinese families are ready, able, and willing. For more than a decade, Chinese applicants have made up the vast majority of EB-5 filings worldwide, because U.S. investment immigration offers better value than most alternatives. Qualified applicants may also consider EB-1A, NIW (National Interest Waiver), EB-2/3 via PERM, L-1 and EB-1C for multinational managers, O-1 and H-1B work visas, and family-based green cards.
