No Decision Long After Your Green Card Interview? Strategies for Background Checks, the I-601 Waiver, and a WOM Mandamus

TL;DR (English): USCIS is now slower and interviews a higher share of I-485 green card cases, so more applicants wait months after an interview with no update. New Weiming Law Group notes: (1) For complex backgrounds — past status overstay, improper affiliations, organizational membership — long silence after the interview often means USCIS added background checks or shelved complex cases; here you should proactively consider filing an I-601 waiver early, rather than waiting for an RFE or NOID that demands a response and waiver within a tight one-month window. (2) For simple backgrounds with mere delay, you can call USCIS, ask a local congressional office to inquire, and, if silence persists, consider a Writ of Mandamus (WOM). Key warning: if materials submitted at or before the interview were already deemed non-compliant, reversing course later is harder; the USCIS policy manual was updated over the past year, so old arguments and methods may no longer apply — do not rely on outdated information. Overall, an in-U.S. I-485 is generally easier to approve, faster, and offers more remedies than consular immigrant-visa processing (NVC). If only the immigrant visa is available, prepare complete documents before the interview, expect possible post-interview background checks, and note that an I-601 waiver typically comes only after a refusal — and if a waiver isn't available but you can enter on another visa, you may then file I-485 inside the U.S. As a trusted Chinese immigration team serving the DMV, Maryland, and Virginia, New Weiming Law Group can help.

In the Greater Washington D.C. area, New Weiming Law Group serves the Chinese community, students, postdocs, and STEM professionals across the DMV, Maryland, and Virginia. USCIS now takes longer to adjudicate cases and interviews a higher share of I-485 green card applications, so more and more people wait months after their interview with no news or update, growing anxious. As a trusted Chinese immigration team, we explain the causes and the responses.

Why Is There No News Long After the Green Card Interview?

This situation often arises because the applicant has a relatively complex background. USCIS has added background-check procedures, or shelves more complex cases for later. In other words, prolonged "no update" is not always bad news, but it frequently means your case has been placed in a category requiring extra review. Especially when the applicant has had a past status overstay, improper affiliations, or organizational membership, long post-interview silence is more likely tied to background checks than to a simple backlog.

If the applicant has had a past status overstay, improper affiliations, or organizational membership, and there is still no news long after the in-office green card interview, they can consider proactively filing an I-601 waiver. Why file early? Because passively waiting may mean that only after receiving an RFE or a NOID are you required to respond and file a waiver within a tight one-month window — leaving too little time and compromising quality. Preparing an I-601 in advance keeps the initiative in your hands. For the specific eligibility and preparation of the I-601 waiver, see the New Weiming Law Group website and related videos.

Simple Backgrounds: How to Push for Status Updates?

  • 给移民局打电话询问案件进度;
  • 联系本地的议员(Congressional office)帮助查询;
  • 对于一直没有消息的 Case,可以考虑催办令 WOM(Writ of Mandamus,向联邦法院请求命令移民局作出决定)

If the background is simple and the application has merely stalled, consider these avenues: call USCIS to inquire about case progress; ask a local congressional office to help check; and for a case with persistent silence, consider a Writ of Mandamus (WOM) — asking a federal court to order USCIS to make a decision. These escalate from light to heavy: first inquire yourself or through a congressional office, and if there is still no result over time, consider a WOM lawsuit to compel a decision within a reasonable time. Whether WOM fits depends on how long you have waited and your case's specifics.

A Key Warning: Once Materials Are Deemed Non-Compliant, Reversing Is Harder

Note carefully: if the applicant submitted information and materials at or before the green card interview that USCIS reviewed and deemed non-compliant, reversing course afterward is harder. We have repeatedly stressed that the USCIS policy manual was updated over the past year, so some arguments and methods that once worked no longer apply. Applicants must closely follow USCIS policy changes and not rely on outdated information. In other words, get it right the first time — once an unfavorable record exists, the room to fix it narrows sharply. That is why pre-interview preparation and document review matter so much.

I-485 Differ from Consular Immigrant Visa Processing?

The above mainly concerns getting a green card inside the U.S. via I-485. Overall, I-485 is generally somewhat easier to approve, faster, and offers more remedies than applying for an immigrant visa abroad through consular processing. If only the immigrant visa is available, note three points: first, prepare well before the interview with complete documents; second, background checks may still occur after the interview; and third, an I-601 waiver typically becomes available only after the immigrant visa is refused. Moreover, if a waiver isn't available but you can enter the U.S. on another visa, you may then file I-485 inside the U.S. — shifting the case from a relatively passive overseas process back to the in-U.S. process with more remedies.

Policy Is Very Different Now — How Should You Prepare?

Immigration policy today is very different from before. Visiting the USCIS homepage and newsroom makes the trend obvious. It is like how the 2026 job market differs greatly from 2016 or 2022 — you must prepare accordingly. Specifically for the post-interview waiting period, the right approach is to first determine whether you are a "complex background" or "simple background" case, then choose the matching strategy: complex cases should assess I-601 and background-check responses early, while simple cases should push via inquiries, congressional assistance, and, if needed, a WOM — all while closely tracking policy changes and avoiding outdated arguments. New Weiming Law Group will use your specific status history to help pinpoint where your case is stuck and what to do next.
