Is the U.S. Green Card Becoming an Unreliable "European-Style" Residence? Faster Visa Bulletin, but I-485 Denials May Come Years Later
New Weiming Law Group | October 2026
TL;DR (English): U.S. green card priority dates have advanced noticeably (in the October 2026 Visa Bulletin, Dates for Filing for China-born EB-1, EB-2, and EB-3 moved to July 2024, January 2023, and April 2024, and F2A Dates for Filing is Current), but faster movement does not mean looser review, nor that a pending I-485 will be approved. Part of the movement may reflect stricter vetting and fewer approvals and visa issuances. An I-485 filed early under Dates for Filing may stay pending for years; at final review, USCIS may re-examine old forms, visa records, organizational memberships, employment history, and evidence. A form error or undisclosed history from years ago can trigger an RFE, NOID, or denial at the last stage, and an applicant who has abandoned independent H-1B or other status may be left with no fallback. Whether EB-1A, NIW, PERM, EB-5, or family-based, prepare from day one to the standard of the final adjudication years later.
New Weiming Law Group is based in the Washington D.C. metropolitan area and represents Chinese nationals, international students, postdocs, and STEM professionals in the DMV region, Maryland, Virginia, and nationwide in EB-1A, NIW, PERM, EB-5, family-based immigration, and I-140/I-485 filings. Green card priority dates have advanced noticeably, which is good news. But as experienced, reliable immigration attorneys, we want to flag a problem many people overlook: the Visa Bulletin may move faster, yet approvals are not necessarily getting easier. Some applicants may wait years after filing an I-485, only to find their green card denied.
What Does Faster Visa Bulletin Movement Really Signal?
Annual family-preference and employment-based green card numbers are capped by statute. More eligible applicants means longer waits; fewer actual approvals can mean faster movement. In the September 2026 Visa Bulletin, the State Department noted that immigrant visa issuances to applicants from certain countries had declined due to national security, public safety, and other policy measures, and that it advanced several categories so annual numbers would be used. In other words, forward movement does not necessarily mean more visas; it may reflect fewer approvals and issuances. We expect some categories may keep advancing under stricter vetting, but this is a trend assessment, not a guarantee, and retrogression remains possible. If others' denials move the line forward, you may benefit; if the denial is yours, faster dates do not help.
| 类别 / Category(中国大陆出生) | 2026年10月 表B / Dates for Filing |
|---|---|
| EB-1 | 2024年7月 / July 2024 |
| EB-2 | 2023年1月 / January 2023 |
| EB-3 | 2024年4月 / April 2024 |
| F2A(绿卡持有人的配偶及未成年子女) | Current(无表B排期限制) |
Two questions now matter equally: When can I file? And once filed, will I actually be approved? Many people used to focus only on the first; the second now deserves far more attention.
Does a Current Dates for Filing Mean Your I-485 Will Be Approved Soon?
不是。绿卡排期有两个表:表A(Final Action Dates,最终裁定日期)决定何时可以使用移民签证名额并获得最终批准;表B(Dates for Filing,申请递交日期)允许符合规定的申请人提前递交材料,在美国境内调整身份的申请人还需USCIS宣布当月可用表B。
No. The Visa Bulletin has two charts: Chart A (Final Action Dates) governs when a visa number is available for final approval; Chart B (Dates for Filing) lets eligible applicants file early, and adjustment applicants inside the U.S. may use it only when USCIS announces so for that month. A current Chart B does not mean Chart A is current; being able to file an I-485 does not mean it can be approved. For example, an applicant with a January 2023 priority date can file when Chart B reaches June 2023 and USCIS allows its use; but if Chart A is still in 2022, USCIS generally cannot grant final approval, and the applicant keeps waiting. The gap between the charts can be months or more than a year, and dates can retrogress. Even after Chart A is current, background checks, interviews, and RFEs can add time. The longer the wait, the more likely the applicant's status, job, and family situation will change.
Why Might an I-485 Be Denied Only After Years of Waiting?
A pending I-485 does not mean USCIS has confirmed every eligibility requirement. An I-485 filed early under Chart B may reach final review only much later. At that point USCIS may re-examine forms filed years earlier, request new documents, re-verify personal history, schedule an interview, or raise issues never fully explored. A seemingly minor mistake from years ago can become serious. Common risks fall into four groups:
Four Common Risks at Final Review
Form errors or omissions: The I-485 runs over twenty pages; some questions ask about the present, others ask "have you ever." If you once belonged to an organization but have since left, a question asking "ever" cannot simply be answered No. If answers later conflict with prior visa applications, immigration records, or résumés, a finding of material misrepresentation can carry consequences far beyond an ordinary RFE.
Incomplete disclosure of history: Past work in government, public institutions, state-owned enterprises, the military, or police, certain memberships, or special training do not automatically bar a green card, but must be disclosed accurately within each question's scope, with explanation where needed. Criminal records, arrests, visa refusals, unauthorized employment, and status gaps also need careful review. The government can compare years of applications, interview records, and public information. Omission and willful fraud are legally distinct, but incomplete information can still cause RFEs, delays, or other adverse results.
Insufficient evidence: For inadmissibility, historical status, or employment questions, a brief personal statement is often not enough; USCIS may require detailed facts and objective evidence. For events years ago in China, the original employer may have relocated, merged, or closed, and staff may have left, making documents harder to obtain.
Changes during the wait: Job changes, unemployment, starting a business, marriage, divorce, children aging, or visa expiration must be analyzed for their effect on the category. PERM job changes implicate the original position, AC21 portability, and Supplement J; EB-1A and NIW are not tied to a specific employer, but intent to continue in the field or proposed endeavor may still need proof; family cases involve the marriage, relationship, and affidavit of support; EB-5 involves the project, source of funds, sustainment, and job creation. An EAD and authorized stay based on a pending I-485 are not an independent nonimmigrant status.
If Your I-140, I-130, or EB-5 Petition Is Approved, Is the Green Card Secure?
Not necessarily. Earlier approvals and final permanent residence are separate legal reviews. An I-140 approval addresses eligibility for the employment category; an I-130 approval confirms the qualifying family relationship; an EB-5 approval covers only one stage of the investor process, and USCIS may later review source of funds and continued compliance. These approvals are the foundation for a green card, but they do not establish eligibility for the I-485 or immigrant visa. At the final stage, the government still reviews inadmissibility, adjustment eligibility, sufficiency of evidence, and whether the underlying basis remains valid; consular officers decide immigrant visas independently. Whether PERM, self-petitioned EB-1A or NIW, family-based, or EB-5, an earlier approval is not a guarantee of permanent residence, and the risk grows the longer you wait.
Why Compare the U.S. Green Card Process to "Unreliable" European Residence?
Historically, a key advantage of the U.S. green card was that, once approved, it generally meant permanent residence, without periodically re-proving the original work, study, or investment basis as some temporary permits require. The physical card expires, but card expiration and loss of status are different things. Europe has no single immigration system: in some countries, foreigners first hold temporary permits and must reside lawfully for a set period before applying for long-term or permanent residence. The EU long-term resident framework generally requires five years of continuous lawful residence plus income, health insurance, and other conditions; the UK has routes from temporary leave to ILR. The common feature: an initial right to live and work does not equal final, stable permanent status. To be clear, permanent residence already granted in Europe is legally protected; the comparison concerns uncertainty on the path to it.
A similar pattern emerging in the U.S.: File the petition and wait → Chart B becomes current, file the I-485 → obtain an EAD and Advance Parole → still pending after one, two, or more years → work, buy a home, marry, have children, enroll kids in school → USCIS begins final review, requests new evidence, questions old history, or denies. Someone who appears settled in the U.S. for years may still be denied, possibly after losing the nonimmigrant status they once could have maintained independently.
That is why we say the U.S. green card is, in some respects, becoming more like "unreliable European residence": not that granted U.S. permanent residence has become temporary, but that the long wait before it is adding uncertainty.
What Is the Most Dangerous Scenario?
The worst case is a denial after years of waiting, with no fallback left. Imagine a Chinese graduate working in the U.S. whose employer files PERM and an I-140. When Chart B is current, he files an I-485, gets an EAD, and stops maintaining H-1B status to change jobs more easily. Over the next few years he changes employers, moves, buys a home, marries, and has children. Then, at final review, USCIS finds a problem in his visa history, asks him to explain past employment or organizational background, or believes material information was not accurately disclosed, and issues an RFE or NOID. Without sufficient evidence and persuasive legal argument, a denial may follow. By then he may have no valid H-1B, his I-485-based EAD and Advance Parole are affected, and his job, family, home, and children's schooling are all at risk. Consular processing abroad would require reassessing inadmissibility and unlawful presence; if a three- or ten-year bar applies, departing could make things worse. Not every denial ground can be cured with an I-601 waiver.
This does not mean every I-485 applicant must keep H-1B status, or that every mistake leads to denial; outcomes depend on the category, facts, and law. But it shows that getting a green card is not only about filing the I-485 early; the filing must withstand final review years later.
What Should Applicants Do?
Prepare from day one to the standard of final review years later. New Weiming Law Group recommends five steps:
Plan early |
Don't wait for the priority date to study the I-485. While pursuing PERM, EB-1A, NIW, EB-5, or family cases, learn the final-stage requirements, what history must be disclosed, and potential vetting or inadmissibility issues; plan any evidence, legal explanation, or waiver early. |
Accurate, consistent forms |
Don't assume when completing the I-485, DS-260, or earlier forms, and don't copy old forms blindly. An error unnoticed at filing can surface later; if you find one, discuss lawful correction with counsel rather than concealing it or improvising at the interview. |
Prepare statements and evidence |
A statement must match the evidence, address the legal issue, and present a clear timeline; add employment letters, status records, school documents, organizational records, family documents, and affidavits as needed. Start early on anything that must come from China. |
Stay compliant while pending |
Assess job changes, status changes, travel, marital changes, long absences, and any arrests. AC21 portability has conditions; Advance Parole does not guarantee reentry in every case. Evaluate whether to maintain independent nonimmigrant status to preserve lawful options. |
Act quickly on RFEs, NOIDs, denials |
Motion to Reopen、Motion to Reconsider或重新申请。 Response windows are short, and repetitive or untargeted submissions may not resolve the issue. Some cases need an I-601 waiver, others new evidence or legal rebuttal; after a denial, evaluate a Motion to Reopen, Motion to Reconsider, or refiling. Not every denial can be reversed, so the best strategy is reducing avoidable risk from the start. |

If your I-485 is already pending, you are waiting for Chart A, or your case has been pending for a year or more, especially if you changed jobs, status, or marital situation, or found errors in past filings, consider having an attorney re-review your materials and status history to catch risks early.
With Faster Dates, What Should Applicants Avoid Most?
The biggest mistake is spending all your effort on filing early while neglecting details that may decide the outcome years later. Many people once worried mainly about slow dates; now dates move faster, but early filing does not make final approval easy. Faster dates are an opportunity; approval is the result. You can wait for the Visa Bulletin, but some errors cannot wait years to be discovered. Rather than paying heavily to fix a denial after losing status, comply from the start, disclose material facts, keep strong evidence, and plan for status changes in the years ahead.
Don't just aim to file the I-485 early; aim to actually get the green card. Opportunity favors the prepared.
