Meanwhile, applicants for new nonimmigrant visas are now being asked whether they fear persecution if returned home — a double-bind question. Visa holders already in the U.S. do not face that specific question, but that does not translate into a discretionary "fast lane." Everyone is in the same boat. The one factor that does help on discretion is having a U.S. citizen or LPR family member as a qualifying equity.

误区三:领馆程序(Consular Processing)一定比 I-485 更稳? / Myth #3: Consular processing is automatically safer than I-485?

A third popular myth: consular processing is "easier to approve" and "easier to appeal" than I-485. This is one-sided. Since last year, immigrant visa refusals at U.S. consulates have risen sharply, often on affiliation-related grounds — frequently at higher rates than I-485 denials. "Appeals" at the consular level are limited and rarely successful. More importantly, the timing of I-601 / I-601A waivers is structurally different: under consular processing, the waiver can only be filed after the immigrant visa is refused; under I-485, the waiver can be filed concurrently with adjustment. Processing waivers from outside the U.S. is also significantly slower. The "safer route" is always a case-by-case determination.

  • 提前准备 discretionary 证据:无论走哪条路,都要把"自由裁量有利证据"档案提前打包好——纳税记录、家庭关系、社区贡献、对美国国家利益的贡献(这正是 NIW、EB-1A 申请人的天然优势)、无犯罪记录、人道因素等。

(2) Run dual-track planning — for EB-5, EB-1A, EB-2 NIW, EB-2/3 PERM, and family-based applicants alike, evaluate I-485 vs. consular processing in parallel and build Plan B (I-601/I-601A waivers, parallel EB-1A and NIW filings, L-1/O-1 backup status, etc.). (3) Pre-build a discretionary equities file — tax records, family ties, community contributions, contributions to U.S. national interest (a natural strength for NIW and EB-1A petitioners), clean criminal record, humanitarian factors. These are valuable on either track.
