Consequences of OPT Fraud (Findream): Wang v. Noem 2025 Federal Court Ruling & Compliance Warning

TL;DR (English): In Wang v. Noem (2025), a federal district court dismissed a lawsuit by an applicant who had engaged in OPT fraud through Findream, holding that USCIS properly exercised its authority to find misrepresentation under INA § 212(a)(6)(C)(i) and that such a determination is not independently reviewable by the court. The ruling sends a clear signal: in the current strict enforcement environment, applicants with OPT fraud or similar histories have very low odds of overturning USCIS decisions through litigation. The more practical strategy is to acknowledge the error and proactively seek an I-601 waiver rather than contest the finding in court.

Over the past 18 months, U.S. immigration enforcement has intensified significantly: increased removals, higher entry refusal rates, more application denials, additional interview and RFE requirements, revocation of previously approved cases, and longer processing times for pending cases. In this environment, compliance in every immigration filing is more critical than ever. New Weiming Law Group, based in Washington D.C. and serving the Chinese community in the DMV, Maryland, and Virginia, provides the following in-depth analysis of Wang v. Noem and practical guidance.

1. Wang v. / What Are the Basic Facts of Wang v. Noem?

申请人王同学(Wang)在美国留学,毕业后在F-1 OPT(Optional Practical Training)期间曾在Findream公司挂靠。

The applicant, Wang, studied in the U.S. and during post-graduation F-1 OPT was nominally employed by Findream—a company later investigated and shut down by USCIS and federal authorities for providing fraudulent employment to international students to maintain OPT status. Wang subsequently changed to H-1B status.

When Wang later filed for another change of status (I-539), USCIS had already completed its Findream investigation. The agency determined that Wang did not actually work at Findream but obtained fraudulent employment documents and made willful misrepresentation of a material fact, rendering him inadmissible under INA § 212(a)(6)(C)(i). His change-of-status application was denied on this basis.

Why Did the Applicant Sue, and What Did the Court Rule?

  • 是否构成"故意虚假陈述"(willful misrepresentation)应当由联邦法院来独立认定,而不是完全由USCIS单方面判断;

USCIS responded with a Motion to Dismiss, arguing the facts and applicable law were clear and did not require further judicial review.

Whether to approve I-539 change of status is within DHS's discretionary authority—the court should not review USCIS's denial.
Whether conduct constitutes misrepresentation is USCIS's factual determination within the administrative process and is not independently reviewable by the court.
  • USCIS的决定有合理依据——不属于arbitrary, capricious, or abuse of discretion。The USCIS decision had a rational basis and was not arbitrary, capricious, or an abuse of discretion.
The court also denied leave to amend the complaint, finding that amendment could not cure the fundamental jurisdictional defect.

What Does This Ruling Mean for Applicants with OPT Fraud History?

Wang v. Noem

Courts defer heavily to USCIS factual findings on fraud/misrepresentation. Overturning such findings through litigation has an extremely low success rate.
Beyond Findream, USCIS and ICE have investigated multiple similar OPT fraud companies. If you were associated with any investigated entity, USCIS likely already has your record.
Denying fraud when USCIS holds company-side investigation evidence (e.g., the company had no actual operations) not only fails but may constitute a second misrepresentation.
Time does not erase the issue. Wang had successfully changed to H-1B after the fraud, seemingly moving on. But USCIS later traced back the Findream history and found inadmissibility. Immigration fraud has no statute of limitations.

What Should Applicants with Fraud History Do Now?

As our firm has previously reported, there are approved cases where applicants with OPT fraud history acknowledged their error and obtained I-601 waiver approval. The I-601 requires showing extreme hardship to a qualifying U.S. citizen or LPR relative.
Do not rely on court litigation. Wang v. Noem demonstrates that courts defer to USCIS discretion. Litigation is expensive, and a loss creates public adverse records.
Prepare every filing meticulously from the start. In the current environment, compliance and evidence quality are paramount. Do not include false information or questionable documentation.
Conduct a comprehensive risk assessment before your next filing. Review your SEVIS record, I-94 history, and past applications to identify potential red flags.
A fraud history does not mean all hope is lost. Through I-601 waiver, consular processing, or—once inadmissibility is resolved via waiver—green card paths such as NIW or EB-1A, lawful status may still be achievable.

How Severe Are the Legal Consequences of INA § 212(a)(6)(C)(i) Misrepresentation?

INA § 212(a)(6)(C)(i)规定:任何人如果通过欺诈或故意虚假陈述重要事实(fraud or willful misrepresentation of a material fact)来获取签证、入境许可或其他移民利益,将被永久认定为不可入境(permanently inadmissible)。

INA § 212(a)(6)(C)(i) provides that any person who, by fraud or willful misrepresentation of a material fact, seeks a visa, admission, or other immigration benefit is permanently inadmissible.

It is a permanent ground of inadmissibility—unless waived.
It blocks future visa issuance, U.S. entry, in-country change of status, and green card applications.
The only administrative remedy is the I-601 waiver, requiring proof of extreme hardship to a qualifying U.S. citizen or LPR spouse or parent. If you have no qualifying relative, the I-601 is unavailable.
