If you already have reasonable NIW qualifications today but decide to "wait a few years until my profile is stronger, then file EB-1A directly" — three years later, your credentials may indeed be stronger. But what did you lose? Three years of Priority Date.

价值一:为H-1B六年后延期提供重要基础
Benefit 1: Enables H-1B Extensions Beyond the 6-Year Cap

H-1B通常有六年的基本期限。但在符合法律条件时,如果申请人已经有批准的I-140、因为移民签证名额等原因不能完成绿卡,可以依据AC21相关规则申请超过六年上限的H-1B延期。所以NIW解决的不只是"什么时候拿绿卡",还可能提前解决另一个现实问题:"H-1B六年以后怎么办?"

H-1B has a standard six-year maximum. However, under AC21 rules, if an applicant has an approved I-140 and cannot complete the green card process due to visa number unavailability, they may apply for H-1B extensions beyond the six-year cap. NIW thus solves not just "when will I get my green card?" but also a critical near-term problem: "What happens after my H-1B's six years are up?"

The principal continues on H-1B while the spouse can work with H-4 EAD — without depending on the H-1B lottery. Note: H-4 EAD requires a separate application and is not automatic upon NIW approval.

How does your education, research, and track record prove you are well positioned to advance this work? And why does waiving the job offer and labor certification requirement serve the national interest?

By some of today's online standards, the advice would have been: "Wait until graduation." "Wait for 10 papers." "Wait for 100 citations." "Wait for peer review." "Wait for job stability." "Wait for a shorter backlog." The result could easily have been years of unnecessary delay.

💡 后来得到的最大教训是:早知道可以这样办,应该更早开始。这并不是说条件越弱越应该申请,也不是说每一个学生都符合NIW。相反,NIW首先必须满足法律要求,案件是否值得提交需要根据个人背景具体分析。但是,不要因为自己还没有达到想象中的"完美简历",或者因为网上有人预测未来八年十年的排期,就连评估都不去做。NIW最宝贵的东西之一,就是给符合条件的人一个机会:先把时间占下来。

The biggest lesson learned: "If I had known this was possible, I should have started even earlier." This doesn't mean everyone should file with weak credentials, or that every student qualifies for NIW. NIW must meet legal requirements, and whether a case is worth filing depends on individual analysis. But don't let the absence of a "perfect resume" or online predictions of 8–10 year backlogs stop you from even getting an evaluation.
