[Success Story] A Green Card in About 18 Months: A Political Science Ph.D.'s NIW Journey, with the I-140 Approved in About One Month Without an RFE and the I-485 Approved in About 4.5 Months Without an Interview

TL;DR (English): The NIW (National Interest Waiver) is not reserved for STEM Ph.D.s. Scholars in political science, sociology, public policy, and other humanities and social sciences can also succeed if they show, under Matter of Dhanasar, that their work has substantial merit and national importance and that they are well positioned to advance it. In this case, Dr. Yang (a pseudonym), a political science Ph.D. and postdoctoral researcher at a U.S. university, studies minority political behavior and government responsiveness, has published sole-authored and co-authored articles in political science journals, completed 5 peer reviews for 4 journals, and submitted 4 recommendation letters from U.S. political science professors (2 independent). The NIW I-140 was filed with Premium Processing in January 2025 and approved in February 2025, in about one month with no RFE; the I-485 was filed in March 2026 and approved in August 2026, in about 4.5 months with no RFE and no interview, for a total of about 18 months. Note that the applicant was born outside mainland China and was subject to a shorter EB-2 backlog, a key reason for the speed. Mainland China-born applicants usually face longer waits even after a fast I-140 approval, but those whose spouse was born outside mainland China may evaluate cross-chargeability to the spouse's country of birth.

For Ph.D.s, postdocs, and early-career scholars doing research in the U.S., a green card means not only stable status but also the freedom to plan an academic career and personal life. Yet employment-based immigration is often associated with biomedicine, computer science, AI, and engineering. Can humanities and social science scholars without heavy citations, patents, or commercial outcomes obtain a green card through the NIW? Today New Weiming Law Group shares the real success story of a young political scientist. New Weiming Law Group is based in the Washington D.C. metropolitan area and represents Chinese nationals, international students, postdocs, and STEM professionals in the DMV region, Maryland, Virginia, and nationwide in NIW, EB-1A, EB-2/3 PERM, and I-140/I-485 matters.

Case Timeline: How Did a Political Science Ph.D. Obtain a Green Card in About 18 Months?

Dr. Yang filed the NIW I-140 with Premium Processing in January 2025, and it was approved in February 2025, in about one month, with no RFE. Once his priority date became current under the applicable chart, he filed an NIW-based I-485 in March 2026, which was approved in August 2026, in about 4.5 months, with no RFE and no interview. From NIW filing to green card approval took about 18 months (roughly 19 months). Note that Premium Processing applies only to eligible I-140s; the I-485 is not automatically expedited, and its speed depends on visa availability, case scheduling, and individual circumstances.

What Was the Applicant's Academic Background?

Dr. Yang holds a Ph.D. in political science and was a postdoctoral researcher at a U.S. university when he applied. His work does not involve traditional high-tech fields such as biomedicine, AI, or semiconductors; instead it focuses on minority political behavior and public policy, closely tied to U.S. elections, minority political participation, public policy, and international relations. Using original interviews, surveys, field experiments, and statistical analysis, his key achievements include:

Journal of Race, Ethnicity, and Politics、American Politics Research及
Publications: articles in political science and public policy journals including the Journal of Race, Ethnicity, and Politics, American Politics Research, and Governance, including sole-authored work on minority political preferences and differential government responsiveness to ethnic groups, and co-authored research on how the Chinese government responds to public policy comments.
Original empirical research: a field experiment sending simulated constituent emails to U.S. state legislators to test whether responses vary by constituent ethnicity, and co-authored analysis of mainland China's policy comment data to study government responsiveness to public input on draft policies.
Peer review: 5 reviews for 4 journals, including the American Political Science Review, Political Behavior, American Politics Research, and Politics, Groups, and Identities.
Recognition: research featured by well-known U.S. universities and academic platforms, and an invited presentation at a U.S. university event.
Expert support: 4 letters from U.S. political science professors, 2 of them independent.

Yet a Ph.D., publications, and letters do not guarantee NIW approval. The key is translating academic achievements into evidence that meets USCIS's legal standard.

Why Did New Weiming Law Group Recommend the NIW?

The NIW is a national interest waiver within the second employment-based preference (EB-2). Unlike EB-1A, the NIW does not require showing that the applicant is among the small percentage at the very top of the field; unlike employer-sponsored EB-2/3 PERM, it waives the job offer and labor certification and allows self-petitioning. Under Matter of Dhanasar, USCIS evaluates whether (1) the proposed endeavor has substantial merit and national importance; (2) the applicant is well positioned to advance it; and (3) on balance, waiving the job offer and labor certification would benefit the United States. For Dr. Yang, the argument was not "he is an excellent political scientist" but "why the United States needs him to continue this research." Political science research often requires cross-institutional collaboration, independent projects, and adapting to social change; freedom from a single employer's sponsorship strongly supports the third prong. We therefore avoided the technology-transfer or commercialization arguments typical of STEM cases and built a full argument around political behavior, public policy, social science methods, and the U.S. national interest.

Without Patents or Revenue, How Can Humanities Scholars Show National Importance?

The substantial merit and national importance required for an NIW are not limited to commercial value or direct economic return. The key is showing impact beyond academia. This case focused on three lines of original research:

Minority political behavior: how national origin and identity shape Asian Americans' political preferences, showing they are not a monolithic group and helping public institutions and policy researchers better understand participation and representation in a multiethnic society.
Responsiveness to Asian American constituents: a field experiment found similar overall response rates for Asian and white constituents but differences in how legislators of different parties responded, providing original evidence on representation and government responsiveness.
China's policy responsiveness: a co-built database of years of mainland China policy comment cases, plus Hong Kong public consultation data, systematically analyzing how government responds to public input and informing U.S. international relations, foreign policy, and comparative policy research.

This research may not generate commercial revenue, yet it carries significant public policy value and national importance, the central line of argument for humanities and social science NIW petitions.

How Did the Petition Show the Applicant Was Well Positioned to Advance His Research?

Rather than relying on the Ph.D. or university position alone, we integrated four mutually reinforcing types of evidence: (1) strong publications, especially sole-authored articles, showing the ability to conduct high-quality independent research; (2) peer review, 5 reviews for 4 journals including a flagship political science journal, showing editors' recognition of his expertise; (3) expert letters from 4 U.S. political science professors explaining, from the perspectives of minority participation, political behavior, international relations, and public policy, how his work fills knowledge gaps, tied closely to his published record rather than generic praise; and (4) a future research plan continuing work on minority political behavior, campaign language strategies, ethnic media's influence on political attitudes, and policy responsiveness in mainland China and Hong Kong, while applying survey design, statistical, and experimental skills more broadly, with clear continuity from past work. The result was a complete argument linking original political science research, U.S. national interest, peer recognition, and sustained research capacity, and the NIW was approved under premium processing in about one month with no RFE.

Why Doesn't a Fast I-140 Mean a Fast Green Card? How Do Birthplace and Backlogs Matter?

An approved I-140 is only one step; the applicant must wait until the priority date is current under the chart that applies that month in the Visa Bulletin before filing an I-485. Employment-based backlogs are determined by country of birth (chargeability), not citizenship, passport, or ethnicity. Born outside mainland China, Dr. Yang was not subject to the mainland China EB-2 backlog and could file the I-485 in March 2026. Mainland China-born NIW applicants usually wait longer even after a fast I-140 approval. However, if the spouse was born outside mainland China, the principal may, if eligible, evaluate cross-chargeability to the spouse's country of birth, which can shorten the wait when the couple files together. Even when the I-485 cannot yet be filed, an approved NIW secures the priority date and offers real benefits for status planning. While waiting, H-1B holders benefit from dual intent; F-1 and J-1 holders do not, so consult counsel before visa applications or travel after filing; J-1 scholars subject to the two-year home residency requirement must obtain a J-1 waiver before filing an I-485, and some scholars may use O-1 as a bridge status.

What Lessons Does This Case Offer Humanities and Social Science Ph.D.s?

The NIW is not STEM-only: the standard does not limit eligible fields, and scholars in political science, sociology, economics, education, public policy, and the humanities can be competitive if they show substantial merit and national importance.
Don't just pile up papers and citations: publications, citations, reviews, and degrees help but do not automatically satisfy the NIW standard; because humanities impact is hard to measure in patents or revenue, petitions must clearly connect the research to U.S. national interest to reduce RFE risk.
I-140 speed differs from green card timing: plan ahead around the priority date, chargeability, and adjustment requirements.
